The following Terms of Use constitute a legally binding agreement between you ("User" or "you") and Scoutize Pty Ltd ("Scoutize", "we", or "us"), the owner and operator of the Accountize web app platform and its affiliated websites and services (collectively, "Accountize"). By accessing, browsing, or using Accountize, you acknowledge that you have read, understood, and agree to be bound by these Terms of Use and all applicable laws and regulations. If you do not agree to these terms, please do not use Accountize.

1. Acceptance of Terms

By using Accountize, you agree to comply with these Terms of Use as well as any additional guidelines or rules that may be posted on the platform from time to time. Your continued use of Accountize constitutes your acceptance of any modifications to these Terms.

2. Changes to Accountize

Scoutize reserves the right to modify, suspend, or discontinue Accountize (or any portion thereof) at any time without prior notice. Any changes to these Terms will be posted on this page, and your continued use of Accountize after such changes constitutes your acceptance of the updated terms.

While we strive to provide accurate and up-to-date information on Accountize, the content may contain technical inaccuracies or typographical errors. Accountize may be updated or modified without notice, and we do not guarantee that all information will be error-free or complete at all times.

5. Data Processing and Privacy

Accountize is a web app platform that requires users to create an account and provide certain personal information. Scoutize collects and processes this information for purposes including, but not limited to, providing the service, sending newsletters, maintaining user records, and improving the platform. We process your data in accordance with our Privacy Policy and applicable data protection laws, including the Australian Privacy Principles under the Privacy Act 1988 (Cth). Where necessary, Scoutize may engage third-party service providers (processors) to assist in providing the service; a list of these processors is available upon request or as otherwise published by Scoutize.

Data will be processed for as long as your account remains active. Upon termination of your account, your data will be retained for 7 days, during which you may request account restoration or data export. After this period, your personal data will be permanently deleted unless retention is required by law.

6. User Conduct and Content

You agree to use Accountize only for lawful purposes and in a manner that does not infringe the rights of, restrict, or inhibit anyone else's use and enjoyment of the platform. You are solely responsible for all content you upload, post, or otherwise transmit via Accountize.

Unlawful or Prohibited Content
While Scoutize does not pre-screen all content on Accountize, if we become aware of any content that violates these Terms or applicable law, we reserve the right to:

• Notify you of the issue,
• Deny its publication or remove it from the platform,
• Request that you rectify the issue, and/or
• Temporarily or permanently restrict access to or delete the offending content.

If you provide evidence that the content in question does not violate these Terms or applicable laws, Scoutize may, at its sole discretion, restore or reinstate the content.

7. Third-Party Links

Accountize may contain links to third-party websites or resources. These links are provided for your convenience only, and their inclusion does not imply any endorsement by Scoutize. We are not responsible for the content or practices of any third-party sites, and you access them at your own risk.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SCOUTIZE, ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES, INCLUDING WITHOUT LIMITATION DAMAGES FOR LOSS OF PROFITS, DATA, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF ACCOUNTIZE OR ANY LINKED THIRD-PARTY WEBSITE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

ACCOUNTIZE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. SCOUTIZE MAKES NO WARRANTIES, EXPRESS OR IMPLIED, REGARDING THE ACCURACY, RELIABILITY, OR AVAILABILITY OF THE SERVICE. ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT, ARE DISCLAIMED TO THE EXTENT PERMITTED BY LAW.

10. Indemnification

You agree to indemnify, defend, and hold harmless Scoutize, its affiliates, and their respective officers, directors, employees, and agents from and against any claims, damages, liabilities, or expenses (including reasonable legal fees) arising from or related to your use of Accountize, your violation of these Terms, or your infringement of any rights of a third party.

11. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of Australia. Any disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of Australia.

12. Modifications to Terms

Scoutize reserves the right to amend these Terms of Use at any time. Any such amendments will be effective upon posting the revised terms on Accountize. It is your responsibility to review these Terms periodically to stay informed of any changes.
